Registration of a foreign trademark in Russia

A foreign company planning to establish protection of its trademarks in the territory of the Russian Federation may apply through the service of Rospatent or through the national patent office of its country. Registration will be carried out according to the rules of the Civil Code of the Russian Federation and international conventions.

How to register a trademark for a foreign company

A trademark is a means of individualization of goods or legal entities. A foreign manufacturer or trading company planning to enter the markets of Russia can register an existing trademark or a newly developed designation. Registration is carried out according to the following rules:

• a non-resident firm can draw up and submit an application through the patent office of its country, or directly through the FIPS (Federal Institute of Industrial Property);
• If the application is filed through a foreign patent office, the company has the right to select an unlimited number of countries for legal protection;
• trademark protection will apply to the classes of products which the applicant has chosen when applying for registration;
• the size of the registration fee will depend on the number of classes of the Nice Classification chosen for protection of the mark.

The obligatory condition for registration of a mark is its uniqueness, i.e. the presented designation must not coincide with similar objects that already have the rights of third parties.

All actions at the stage of preliminary information search, application and registration can be performed by the company itself or through patent attorneys. The application submitted to FIPS must be drawn up in Russian. If a company applies to the patent office of its own country, the application can be made in the native language, but a translation will be required for the verification of the designation.

As a result of the registration a non-resident company will get a trademark certificate. Its term of validity is 10 years, after which an unlimited number of extensions is allowed. After obtaining the certificate, the foreign company will be able to use the trademark for the sale of its products, sell it to others or transfer it for a temporary period. Also, passed registration gives the opportunity to implement any means of protection against unfair practices of competitors, including the use of the trademark in the production of counterfeit products.
